1ST DEGREE MURDER (2017): Criminal Defense Investigation. Client arrested for the murder of a 2 year old child. The child was found deceased in her bed in the middle of the night. Police immediately focused on our client to the exclusion of all others. The police investigation was flawed, biased and the result of tunnel vision. Our defense investigation, over a two year period, unveiled implausible and fictitious information relied upon for search warrants and the arrest of our client, with the prosecution originally seeking the death penalty.
Critical evidence was mishandled, overlooked, and not seized from the scene of the crime. Potential suspects were overlooked and witnesses never interviewed. Some interviews were recorded, some not.
The Prosecution abandoned the death penalty several months before trial, but maintained the first degree murder charge. The trial endured for over 3 weeks. The jury returned with a NOT GUILTY verdict after approximately 12 hours of deliberation.
FELONY AGGRAVATED ASSAULT-2 COUNTS (2016): Criminal Defense Investigation. Police arrested and booked client on probable cause investigation, alleging that he intentionally rammed the victims' vehicle head-on causing minor injuries. There was no positive ID or subsequent photo line-up shown to victims. Prosecutor filed 2 counts of felony aggravated assault. Our investigation found 4 alibi witnesses, never interviewed by officers, who could account for client's whereabouts during the incident. Additionally, we located several witnesses who were prepared to testify who was actually driving the vehicle at the time of the incident, and admitted it to our witnesses. Our witnesses came to court (not subpoenaed) and were interviewed by the prosecutor prior to the preliminary hearing. The charges against out client were dismissed.
RAPE (2016): Criminal Defense Investigation. Client with no criminal record accused, arrested, and charged with rape. Our review of the forensic evidence, coupled with witness statements, and facts not disclosed or reported in the original complaint, resulted in a complete dismissal by the prosecutor.
MURDER (2016): Criminal Defense Investigation. 2nd degree murder charged in an accidental death. Murder charge dismissed and guilty plea to involuntary manslaughter.
MURDER (2015): Criminal Defense Investigation. Dismissed. Guilty plea to manslaughter. Sentence under appeal.

MURDER OF FOSTER CHILD: Criminal Defense Investigation proved the death was a result of child falling down stairs. Charges dismissed against clients.
VOLUNTARY MANSLAUGHTER: Criminal Defense Investigation established evidence of self defense. Felony charge dismissed. Guilty plea to misdemeanor exhibition/use of deadly weapon. 2 years probation, $277 fine.
